Introduction

These Terms and Conditions explain the rules that apply when you use the One of A Kind Castle website, take the Castle Discovery Quiz, create an account, purchase a membership or use Castle content and community spaces.

In this document, "the Castle", "we", "us" and "our" mean One of A Kind Castle. "You" and "member" mean the person using the website or purchasing a membership.

Please read these terms before purchasing. Nothing in them removes or limits your statutory consumer rights.

1. Who We Are and How to Contact Us

One of A Kind Castle is operated by Karen Kay, trading as One of A Kind Castle.

2. Who May Join

Castle memberships are intended for people aged 18 or over. By purchasing a membership, you confirm that you are at least 18 and that the information you provide is accurate.

Your membership and account are personal to you and must not be shared with another person.

3. Membership Payments and Automatic Renewal

Your membership begins immediately after purchase and renews automatically each month or year, depending on the plan you selected, until you cancel it.

The price and billing frequency will be shown before you complete your purchase. Your membership fee will be charged automatically to your chosen payment method. Please keep your payment details valid and up to date.

If we need to change the price of a membership that is not protected by a locked-in rate, we will give you reasonable notice before the new price applies. You may cancel before the change takes effect.

4. Promotional and Locked-In Prices

A promotional, discounted or locked-in price applies only for the period and under the conditions stated with that offer.

Unless an offer says otherwise, a locked-in membership price continues only while the membership remains active without interruption and payments remain up to date. If you cancel or the membership ends, the locked-in price ends. If you later rejoin, the price available at that time will apply.

5. Access to the Castle

You will have access to the Castle's quests, community spaces, resources and membership updates while your membership is active and your payments are up to date.

Some community spaces, videos or live sessions may be provided through trusted third-party platforms. You may also need to follow the reasonable rules and terms of those platforms.

6. Failed Payments

If a payment fails, we will try to notify you and may temporarily suspend your Castle access until the payment issue is resolved.

We are not responsible for fees charged to you by your bank, card provider or payment provider.

7. Cancelling Your Membership

You may cancel your membership at any time through your account dashboard. If you need help, you may contact us for assistance.

To prevent your next membership payment, you must cancel before that payment is processed. Cancellation stops future renewal payments. After cancellation, you will normally continue to have access until the end of your current paid period.

Cancelling does not automatically provide a refund for payments already made. The cancellation and refund rights described in the next section still apply.

8. Cooling-Off Rights, Digital Access and Refunds

UK law may give you a 14-day cooling-off period when you purchase online. Your exact rights can depend on whether you are receiving digital content, ongoing services or both.

If you ask for immediate access to digital content during the cooling-off period, we will ask you separately at checkout to give your express consent and acknowledge that you will lose the right to cancel that digital content once its supply begins.

Different rules may apply to ongoing services supplied during the cooling-off period. If you have a legal right to cancel, any amount charged or refunded will be handled as required by law.

Outside any applicable cooling-off or statutory refund right, payments already made are normally non-refundable once access has been provided. We do not normally offer partial or prorated refunds for an unused part of a paid membership period.

Your statutory rights remain unaffected. This includes rights that may apply if digital content or services are faulty, unavailable, not as described or not provided with reasonable care and skill.

9. Payment Disputes and Chargebacks

If you believe a payment has been taken incorrectly, please contact us so we can investigate and try to resolve the matter quickly and kindly.

If a payment is disputed or reversed, membership access may be temporarily suspended while the matter is investigated. We may provide relevant payment, membership-access and terms-acceptance records to the bank or payment provider.

Where we have reasonable evidence of fraud or deliberate chargeback abuse, we reserve the right to refuse a future membership application.

Nothing in this section restricts your statutory rights or your right to contact your bank or payment provider.

10. Community Conduct

The Castle is intended to be a supportive and welcoming community. Members must communicate with others respectfully.

Bullying, harassment, discriminatory language, threats, deliberate disruption, unlawful behaviour or sharing another person's private information without permission will not be accepted.

We may remove inappropriate content and, in serious or repeated cases, suspend or end access to community spaces. We will act reasonably and fairly when considering a reported concern.

If you experience a problem or need assistance, please contact us and we will do our best to help.

11. Ending or Suspending a Membership

We may suspend or end a membership if payments remain unpaid, if these terms are seriously or repeatedly broken, if the community or another person is placed at risk, or if we are legally required to do so.

Where appropriate, we will explain the concern and give the member a reasonable opportunity to respond or correct it. Immediate action may be taken where reasonably necessary to protect people, information, the community or the Castle.

Any refund following suspension or termination will depend on the circumstances and your statutory rights. We will not use this section to remove rights provided by law.

12. Personal Use and Copyright

All quests, videos, downloads, written materials, artwork, characters, branding and other Castle content belong to One of A Kind Castle or are used with permission.

Your membership gives you permission to use Castle materials for your own personal, non-commercial use.

You must not copy, record, reproduce, modify, publish, share, sell or redistribute Castle materials without our written permission. You must not use the materials to create or provide a competing course, membership, product or service.

You keep ownership of content you create and post in a community space. By posting it, you give us permission to display it within that community for the purposes for which it was shared. Please only post material you have the right to share.

13. Educational and Health Information

One of A Kind Castle provides educational information and general support relating to mindset, habits, wellbeing, movement and fitness.

Castle content is not medical advice and is not a substitute for diagnosis, treatment or individual advice from a qualified healthcare professional.

Please consult your GP or another suitably qualified healthcare professional before beginning a new diet or exercise programme, particularly if you have an existing health condition, injury, pregnancy or other concern.

You are responsible for deciding whether an activity is suitable for you. Stop exercising and seek appropriate advice if you experience pain, dizziness, illness or unusual discomfort.

Please do not post detailed medical information in community spaces. If health information is needed for a specific Castle activity, we will explain why it is needed and how it will be used.

14. Results and Personal Responsibility

People's circumstances and results are different. We cannot guarantee weight loss, fitness changes, health improvements, financial results or any particular outcome from using the Castle.

Examples, stories and testimonials describe individual experiences and are not promises that every member will achieve the same result.

15. Website Accuracy, Changes and Availability

We take reasonable care to keep the website and Castle materials helpful, accurate and available. However, we cannot promise that every page will always be free from errors or that the website will always operate without interruption.

We may update, replace or improve content and features as the Castle develops. We will not materially reduce the main membership service without a reasonable reason and, where appropriate, reasonable notice.

We may occasionally need to maintain or temporarily suspend parts of the website. We will take reasonable steps to restore access.

Nothing in these terms excludes or limits responsibility that cannot legally be excluded.

16. Links and Third-Party Services

The website and membership may contain links to websites or services operated by other organisations.

We are not responsible for the content, availability, security or privacy practices of those external services. Please read their own terms and privacy information before providing personal information or making a purchase.

17. Privacy Notice

We respect your privacy and take appropriate steps to protect your personal information. This section explains the main ways we collect and use it.

17.1 Information We May Collect

Depending on how you use the Castle, we may collect:

  • Your name, email address and contact details.

  • Account, membership, purchase and transaction information. Full card details are normally handled by the payment provider rather than by us.

  • Quiz answers, form responses, survey responses and preferences you choose to provide.

  • Messages, support requests, comments and content you choose to share with us or in Castle community spaces.

  • Technical and usage information, such as IP address, device or browser information, pages visited, access times and cookie choices.

17.2 Why We Use Your Information

We may use personal information to:

  • Create and manage your account and membership.

  • Process payments and maintain transaction records.

  • Provide quiz results, Castle content, support and community access.

  • Send essential account, payment, security and service messages.

  • Send marketing emails where we have the appropriate permission.

  • Protect the security of the website, members and the Castle.

  • Improve our website, content and member experience.

  • Handle enquiries, complaints, payment disputes and legal obligations.

17.3 Our Lawful Reasons for Using Information

We only use personal information when we have a lawful reason. Depending on the purpose, this may be:

  • To perform our contract with you, such as providing your membership.

  • Your consent, such as for marketing or non-essential cookies. You may withdraw consent at any time.

  • A legal obligation, such as keeping accounting records or responding to a lawful request.

  • Our legitimate interests in operating, protecting and improving the Castle, provided those interests do not unfairly override your rights.

17.4 Sharing Information

We do not sell or rent your personal information.

We may share only the information needed with trusted providers that help us operate the Castle, such as website and hosting providers, payment processors, email services, video or meeting platforms, analytics services and community platforms.

We may also share information with professional advisers, regulators, law-enforcement bodies or other organisations where it is reasonably necessary to protect legal rights, prevent fraud or comply with the law.

Some providers may process information outside the United Kingdom. Where data-protection law requires it, we will rely on appropriate safeguards for those transfers.

17.5 How Long We Keep Information

We keep personal information only for as long as it is reasonably needed for the purpose for which it was collected, including providing your membership, answering enquiries, maintaining security and meeting tax, accounting or legal requirements.

When information is no longer required, we will delete it, anonymise it or securely retain it only where the law requires us to do so.

17.6 Your Data-Protection Rights

Depending on the circumstances, you may have the right to ask us to:

  • Provide a copy of your personal information.

  • Correct inaccurate or incomplete information.

  • Delete or restrict the use of your information.

  • Stop using your information for direct marketing.

  • Consider an objection to certain uses of your information.

  • Transfer information you provided where the right to data portability applies.

You may withdraw consent at any time where we rely on consent. Withdrawing consent does not make earlier lawful use of your information unlawful.

You also have the right to complain to the Information Commissioner's Office. Information is available at ico.org.uk/make-a-complaint.

18. Emails

We may send essential emails about your account, payments, membership, security or important service changes. These are not marketing messages and may still be sent while you have an active account or membership.

We will only send marketing emails where we have the appropriate permission or another lawful basis that applies. You may unsubscribe from marketing at any time by using the unsubscribe link in an email or contacting us.

19. Cookie Notice

Cookies and similar technologies are small files or tools used by websites to remember choices, provide functions, understand usage and, where permitted, support marketing.

The Castle may use:

  • Essential cookies needed for security, account access, payments, cookie choices and the basic operation of the website.

  • Functional cookies that remember preferences or support optional website features.

  • Analytics cookies that help us understand how visitors use the website.

  • Marketing cookies used to measure or personalise advertising, where applicable.

We will ask for an appropriate choice before using non-essential cookies unless the law permits another approach. You can accept, reject or manage available cookie categories through the website's cookie settings.

Blocking some cookies may affect how optional parts of the website work. Third-party features, such as embedded videos, may also use their own cookies when you choose to interact with them.

Access to personal information is limited to authorised employees, contractors and trusted service providers who need it for their work.

We use appropriate technical and organisational measures to help protect personal information from unauthorised access, loss, misuse, alteration or disclosure. No internet service can guarantee complete security, but we take reasonable steps appropriate to the information we hold.

21. Events Outside Our Reasonable Control

We will not be responsible for delay or interruption caused by circumstances reasonably outside our control, such as widespread internet failure, serious technical disruption, natural disaster or failure of an essential third-party service.

Where possible, we will take reasonable steps to reduce the disruption, restore the affected service and keep members informed.

22. Changes to These Terms and Notices

We may update these terms, the Privacy Notice or Cookie Notice when our services change or when changes are needed for legal, security or operational reasons.

The latest version and its effective date will be published on the website. We will provide reasonable notice of any significant change affecting an active membership or the way we use personal information.

Changes will not remove your statutory rights. A material change to an existing membership contract will only apply as permitted

by law.

24. Governing Law and Severability

These terms are governed by the laws of England and Wales. Nothing in this section removes any consumer right you may have concerning which country's law applies or where a dispute may be considered.

If any part of these terms is found to be invalid or unenforceable, the remaining sections will continue to apply.

25. Agreement to These Terms

By ticking the general terms-acceptance box and completing your purchase, you confirm that you have read and agreed to these Terms and Conditions.

This general acceptance must be kept separate from any express consent and acknowledgement required for immediate digital access during a statutory cooling-off period.
